These Terms and Conditions (T&C) apply to all contracts between GOTAT.ME – Juri Bücker, Rehornweg 50, 26180 Rastede, Germany (the "Provider") and users of the GOTAT.ME service (the "Customer"). The service is intended exclusively for business users (tattoo artists and tattoo studios).
1. Description of Service
GOTAT.ME provides tattoo artists with tools to create customized online booking pages ("Booking Pages") that streamline client communication and appointment handling without changing the artist's existing workflow.
2. Contract Formation and Trial Period
- The contract is concluded when a Customer registers via the GOTAT.ME website.
- Each new Customer receives a two-month free trial that does not renew automatically.
- After the trial, the Customer may optionally continue with a paid subscription.
3. Prices and Payment
- The service costs €10 per month. VAT not applicable pursuant to Section 19 UStG (small business regulation).
- Payments are processed monthly via PayPal.
- Access remains active as long as the subscription is paid.
4. Term and Termination
- Subscriptions run on a monthly basis and can be cancelled at any time with immediate effect.
- Fees already paid are non-refundable.
5. Customer Obligations
- Provide complete and accurate registration details and keep login credentials confidential.
- Ensure Booking Page content does not include illegal, offensive, discriminatory, or infringing material.
6. Availability and Third-Party Services
The Provider strives for high availability but does not guarantee uninterrupted operation. Components of the service depend on third-party providers (e.g., Typeform, PayPal, hosting). Downtime or disruptions caused by third parties are outside the Provider's responsibility.
7. Liability
The Provider is liable only for damages caused by intentional or grossly negligent conduct. Liability for slight negligence is excluded to the extent permitted by law. The Provider is not liable for data loss, downtime, or service interruptions caused by third-party providers such as Typeform or PayPal.
8. Data Protection
Personal data is processed and stored in encrypted form. Processing is carried out in accordance with the Privacy Policy of GOTAT.ME.
9. Intellectual Property
All trademarks, logos, and content provided by the Provider remain the property of their respective owners. The Customer retains rights to content they submit, and grants the Provider a non-exclusive license to host and display such content for the purpose of operating the service.
10. Final Provisions
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- Place of jurisdiction is Rastede, Germany.
- If any provision is invalid, the remaining provisions remain in effect.
